What construction contracts does Padu Legal advise on?
We advise on PAM (Pertubuhan Arkitek Malaysia) contracts, CIDB standard forms, and FIDIC-based contracts. This covers JKR, IEM, and bespoke contracts used in infrastructure and private development projects across Malaysia. Our advisory includes both drafting new contracts and reviewing existing ones before execution.
How does CIPAA adjudication work and how long does it take?
CIPAA 2012 provides a statutory adjudication process for unpaid construction parties. Once a payment claim is submitted, the responding party has 10 working days to respond, and an adjudicator is appointed by KLRCA (AIAC). The adjudicator then delivers a decision within 45 working days. From start to finish, the process typically takes four to eight weeks, depending on complexity and whether both parties are engaged.
Who can use CIPAA — only main contractors?
No. CIPAA applies to any construction contract — including those between main contractors and subcontractors, nominated subcontractors, suppliers, and consultants. Both parties in a payment dispute can invoke CIPAA, including the responding party in appropriate circumstances. It applies to written construction contracts executed in Malaysia, with some specific exceptions under the Act.
What documents do I need to start a payment claim?
At minimum, you will need your construction contract (or written records of the contract terms), progress claim submissions and certifications, correspondence relating to the unpaid amount, and any payment certificates or rejection notices. Our team conducts a payment-chain analysis at the start of each engagement to identify which documents are material and what may be missing.
Can you assist with disputes involving delay claims and extension of time?
Yes. Delay claims and extension of time disputes are part of our Project Dispute Resolution service. These often require analysis of project programmes, site records, and correspondence to establish critical path impact and employer-caused delays. We work with delay analysts and quantum experts where the dispute warrants independent technical input.
How is your fee structured for each service?
Our Construction Contract Advisory starts from RM 700, depending on contract length and complexity. Payment Dispute & Adjudication engagements start from RM 1,600, structured by stage. Project Dispute Resolution is quoted from RM 3,100 based on dispute scope and intended forum. Each engagement begins with a brief consultation to understand your matter before formal instructions are taken.
